Purpose

In compliance with the European General Data Protection Regulation 2016/179 and other applicable data protection regulations, we inform you that Miphai will process the data you provide us with the following purposes:

1. Properly managing our services, consisting of:
- Managing your user account on Miphai’s website.
- Purchase and shipment of the Miphai product you have purchased, as well as sending your purchase receipt to the email address you provide.
- Managing our services, including but not limited to reminders, technical notices, updates, security alerts, and technical support messages.
- Recording and managing the resolution of in-store and online incidents.
- Recording and managing communication channels between the client and Miphai, through our chat, letter, email, or phone, including recording your calls with our customer service.

2. Sending commercial communications to inform you about our products and news, provided we have your consent.
3. Analyzing your behavior as a user and creating a commercial profile to show you personalized advertising tailored to your preferences and, if applicable, your browsing history. Miphai created your commercial profile based on data collected through third-party sources, such as their cookies. No automated decisions with legal or similar significant effects were made based on this profile. The commercial profile created through cookies may be used by third-party websites to show you personalized advertising. You can manage your cookies by following the instructions in our Cookie Policy.
4. Additionally, Miphai created your commercial profile based on internal sources, such as:
- The information you provide us.
- Miphai’s own cookies.
- Your purchase history.
- The frequency with which you open your emails.
- Your responses to surveys.
5. Preventing abuse and fraud in the use of our services (e.g., fraudulent activities, denial of service attacks, spam, etc.).
6. Data transfer to public authorities and bodies whenever required by legal and regulatory norms.

Data Retention Period

Your data will be retained while the contractual and commercial relationship is maintained, according to recommended or legally established periods, and, in any case, until the legal prescription of any actions that may arise.

Legitimization

The legal basis for processing your data is:

1. The execution of a contract with Miphai concerning the previous section 1.
2. The consent you have provided, concerning the purposes indicated in sections 2, 3, and 5 above.
3. The legitimate interest of Miphai, concerning the purposes indicated in sections 4 and 6 above.
- Regarding section 4, the legitimate interest is based on creating a profile of our customers related to direct marketing and consists of showing you products that we believe may interest you due to their "similarity" to other products of the brand you have previously purchased and based on your commercial profile. For this purpose, Miphai will track your behavior to determine if you might benefit from other Miphai brand offers or products. Your commercial profile is created with information belonging to Miphai.
- Regarding section 5, the legitimate interest is based on protecting Miphai users by preventing abuse and fraud in the use of our services.
4. Compliance with Miphai’s legal obligations, for the purpose indicated in section 6.

Recipients

Your personal data may be processed by providers who provide services to Miphai concerning the purposes described, such as content hosting services, instant messaging, communication delivery, advertising services, etc. Miphai has signed the relevant data processing contracts with each provider to ensure your personal data is treated following applicable legislation.
Your personal data may also be transferred when there is a legal obligation.
Your personal data will be processed within the territory of the European Union. However, if necessary, for technical or operational reasons, Miphai reserves the right to transfer your personal data to countries outside the European Economic Area, subject to the existence of adequacy decisions by the European Commission or based on appropriate safeguards or specific exceptions under the GDPR. In this regard, you will be informed about these data transfers and their characteristics if applicable.

Commercial Communications

In accordance with Article 20 and following of Law 34/2002, of July 11, on information society services and electronic commerce, Miphai does not send commercial communications by email unless expressly authorized by the recipient. In any case, the user can request, at any time, not to receive commercial information through customer service channels or by writing to the email address administracion@miphai.com.

Mobile Service Terms

Miphai’s mobile messaging service is operated by Miphai. Using the Service constitutes your acceptance of these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service after the effective date of any changes will constitute your acceptance of those changes.

By consenting to Miphai's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Miphai through your wireless provider at the mobile number you provided, even if your number is on a state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, special offers, and other marketing offers (e.g., cart reminders).

You understand that you are not required to sign up for this program to make purchases, and your consent is not a condition for any purchase with Miphai. Your participation in this program is entirely voluntary.

We do not charge for the Service, but you are responsible for all text messaging charges and fees imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Consult your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including those from your wireless provider.

You can opt-out of the Service at any time. Text the keyword STOP to Miphai or click the unsubscribe link (if available) in any text message to cancel. You will receive a one-time confirmation of your cancellation. No further messages will be sent to your mobile device unless you initiate it. If you have subscribed to other Miphai mobile message programs and wish to cancel, except as required by applicable law, you must opt-out separately from those programs by following the instructions provided in their respective mobile terms.

For support or assistance with the Service, text the word HELP to Miphai or email administracion@miphai.com.

We may change any short code or phone number we use to operate the Service at any time, and we will notify you of these changes. You acknowledge that any message, including any request to STOP or HELP, sent to a short code or phone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for any failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or the Service.
